These Terms govern your use of nemtrepreneur.com, including the NEMT Provider Directory, provider profile pages, listing claims, paid listing services, the newsletter, and any related content (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
NEMT Entrepreneur is an information and media resource for the non-emergency medical transportation (NEMT) industry. The Provider Directory publishes business information about NEMT providers so that facilities, brokers, payers, and the public can find them.
The Service is not a transportation broker, dispatcher, scheduler, or booking platform. We do not arrange, schedule, or provide transportation, and we are not a party to any transaction between a provider and anyone who contacts them. Nothing on the Service is medical, legal, financial, or regulatory advice. If you have a medical emergency, call 911.
Unclaimed listings are compiled from public sources, including the CMS National Plan and Provider Enumeration System (NPPES/NPI Registry), state business registrations, and information providers publish about themselves on the open web. We publish this data as a public reference. We do not verify unclaimed listings, and inclusion in the Directory does not mean we endorse, recommend, or have any relationship with a provider.
A listing marked "Unclaimed" has not been reviewed or confirmed by the provider. A listing marked "Verified" has been claimed by someone who represented that they are authorized to act for the business and has passed our ownership check. "Verified" means we confirmed ownership of the listing; it is not a statement about licensing, insurance, safety, service quality, or compliance.
If you are the provider named in a listing and you want it corrected or removed, email contact@nemtrepreneur.com from a company email address, or use the claim form. We will act on reasonable, verified requests within a commercially reasonable time. Because unclaimed listings are drawn from public records, we may decline to remove information that remains public elsewhere, but we will remove or correct it on our site.
To claim a listing you must be an owner, officer, or employee authorized to act for the business. By submitting a claim you represent that this is true, that the information you provide is accurate, and that you will keep it current. We may ask for proof (for example, a call to the number on file or an email from the company domain), and we may refuse, suspend, or revoke a claim at any time if we believe it is inaccurate, unauthorized, or misleading.
Claiming a listing gives you the ability to supply content for your profile (logo, hours, service types, service area, website, and similar). You are responsible for that content. Do not submit anything you do not have the right to publish, anything false or misleading, or anything that violates law or the rights of others.
We offer paid services such as Verified listings, Featured placement, Spotlight articles, and website or launch packages ("Paid Services"). Prices, billing frequency, and what is included are stated at the point of purchase and may change for future terms with notice.
Payment is due in advance. Annual plans renew automatically at the then-current price unless you cancel before the renewal date. You may cancel at any time; cancellation stops future renewals and does not refund the current term. Fees are non-refundable once a Paid Service has been activated, except where required by law or where we fail to deliver the service and cannot cure it within a reasonable time after you notify us.
Promotional pricing (for example, "Founding 100" pricing) applies only while the listing remains continuously active and in good standing. If a plan lapses, promotional pricing is not guaranteed on reactivation.
Featured and sponsored placements are paid positions and are labeled as such. Paid placement affects where a listing appears; it does not affect whether a listing can be Verified, and we do not sell claims of being "#1" or "best." We do not guarantee any number of views, leads, calls, or business results from any listing or Paid Service.
Parts of the Service may be sponsored by industry vendors, and sponsorships are disclosed where they appear. A provider may choose to display a vendor badge (for example, a "Powered by [software]" mark) on its own listing to indicate that it uses that vendor's product. That badge is the provider's statement, displayed at the provider's request, and does not mean the vendor endorses the provider or that we endorse the vendor.
The Service is not designed to receive or store protected health information (PHI) or any patient, rider, or trip details. Do not submit patient names, dates of birth, medical conditions, trip requests, or similar information through any form on the Service. To request transportation, contact the provider directly using the information on its listing, and use the provider's own intake process. We are not a covered entity or business associate under HIPAA and do not accept PHI.
You agree not to: scrape, harvest, or bulk-download Directory data by automated means without our written permission; misrepresent your identity or affiliation; claim a listing you are not authorized to claim; post content that is false, defamatory, infringing, or unlawful; interfere with the operation or security of the Service; or use the Service to send unsolicited commercial messages to providers listed in it. We may suspend or terminate access for violations.
If you subscribe to the newsletter or check the newsletter box on a form, we will send you email about the NEMT industry and about the Service. You can unsubscribe at any time using the link in any email. If you claim a listing, we will contact you about that listing and your account regardless of newsletter preferences.
The Service, including its design, text, articles, compiled Directory, and trademarks, is owned by us or our licensors and is protected by law. You may view and print pages for your own business use. You may not copy, republish, or redistribute the Directory or substantial parts of it. Content you submit remains yours; by submitting it you grant us a non-exclusive, royalty-free, worldwide license to host, display, and distribute it as part of the Service and to promote the Service, for as long as your listing is live and for a reasonable period afterward for archival purposes.
The Service and all Directory data are provided "as is" and "as available." Directory data may be incomplete, outdated, or wrong, and you should confirm any information directly with a provider before relying on it. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to the Service, even if advised of the possibility. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for Paid Services in the twelve months before the claim or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations; in those places our liability is limited to the extent permitted.
You will defend and indemnify us and our officers, contractors, and affiliates against claims, losses, and expenses (including reasonable attorneys' fees) arising from content you submit, your use of the Service, or your breach of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access, remove content, or delete a claimed listing if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive (including 9 through 15) survive termination.
We may update these Terms. We will post the updated Terms with a new effective date and, for material changes affecting Paid Services, notify claimed-listing contacts by email. Continued use after the effective date is acceptance of the updated Terms.
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in St. Louis County, Missouri, and you consent to their jurisdiction. Before filing a claim, you agree to contact us at contact@nemtrepreneur.com and attempt in good faith to resolve the dispute for at least thirty days.
