What is drug and alcohol testing in NEMT?

Drug and alcohol testing in NEMT is the program of pre-employment, random, reasonable-suspicion and post-accident testing that brokers and state Medicaid programs require for drivers and attendants. Most NEMT vehicles are below the size that triggers federal DOT/FMCSA testing rules, so the requirements come from contracts and state regulations instead, and they often mirror the DOT program: a written policy, a random pool, a certified lab and documented results.

Why testing matters for NEMT

Testing is a credentialing requirement and a liability shield. A post-accident test that was never performed becomes the plaintiff's first exhibit. Set up a consortium or third-party administrator to run the random pool, keep results in a confidential file separate from the personnel file, and add testing status to the driver qualification checklist that credentialing reviews.
